Terms of Service
Please read these Terms of Service carefully before using Vilora's. By accessing or using our platform, you agree to be bound by these terms. These terms apply globally including to users in India, the EU, the UK, the US, and all other jurisdictions.
1. About Vilora's
Vilora's is an online marketplace that connects guests seeking luxury accommodation with hosts offering properties for short-term rental. Vilora's acts as an intermediary and is not a party to the rental agreement between guests and hosts.
2. Eligibility
- You must be at least 18 years old to use Vilora's
- You must have the legal capacity to enter into binding contracts
- You must not be prohibited from using our services under applicable law
- By using Vilora's, you represent and warrant that you meet these requirements
3. User Accounts
3.1 Account Registration
You must create an account to make or receive bookings. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Account Termination
Vilora's reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to our community.
4. Bookings & Payments
4.1 Booking Process
When you book a property, you enter into a rental agreement directly with the host. Vilora's facilitates the transaction but is not a party to this agreement.
4.2 Payments
- All payments are processed securely via Razorpay
- Prices are displayed in Indian Rupees (INR)
- Hosts receive payouts after the guest's check-in, minus Vilora's commission (10%)
4.3 Taxes
For users in India, GST may be applicable as per the GST Act. Hosts are responsible for compliance with local tax regulations including GST registration if applicable.
5. Cancellation Policy
5.1 Guest Cancellations
- Free cancellation: Cancel within 48 hours of booking for a full refund
- 7+ days before check-in: 50% refund of accommodation cost
- Less than 7 days: No refund unless host agrees
5.2 Host Cancellations
If a host cancels a confirmed booking, the guest receives a full refund. Hosts who repeatedly cancel may face penalties including removal from the platform.
6. Host Responsibilities
- Provide accurate property descriptions, photos, and pricing
- Maintain the property in a safe and clean condition
- Comply with all local laws, regulations, and zoning requirements
- Obtain necessary licenses and permits for short-term rentals
- Pay applicable taxes including GST (India) or equivalent
- Respond to booking requests within 24 hours
- Not discriminate against guests based on race, religion, gender, nationality, or any protected characteristic
7. Guest Responsibilities
- Treat the property and host's belongings with respect
- Comply with house rules set by the host
- Not exceed the maximum number of guests specified in the listing
- Report any damage to the host and Vilora's promptly
- Vacate the property by the agreed check-out time
- Not engage in illegal activities on the premises
8. Prohibited Activities
The following activities are strictly prohibited on Vilora's and may result in immediate account termination and legal action.
- Providing false or misleading information
- Using Vilora's for commercial purposes other than legitimate hosting
- Attempting to circumvent Vilora's platform to avoid platform fees
- Harassment, abuse, or threatening behaviour towards other users
- Posting illegal content or content that violates third-party rights
- Using automated tools to scrape or misuse the platform
- Money laundering or fraudulent payment activity
9. Intellectual Property
All content on Vilora's including logos, trademarks, designs, and software is owned by Vilora's or its licensors. You may not reproduce, distribute, or create derivative works without our written permission. By uploading photos or content, you grant Vilora's a non-exclusive licence to use that content on our platform.
10. Limitation of Liability
To the maximum extent permitted by law:
- Vilora's is not liable for disputes between guests and hosts
- Vilora's is not responsible for property damage, personal injury, or loss of belongings
- Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
- We are not liable for indirect, consequential, or punitive damages
Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence.
11. Governing Law & Dispute Resolution
For users in India:
These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra. Consumer disputes may be referred to the Consumer Disputes Redressal Commission as per the Consumer Protection Act, 2019.
For users in the EU/UK:
EU/UK users may also have rights under applicable consumer protection laws. Nothing in these Terms affects your statutory rights as a consumer.
For users in the US:
US users agree to binding arbitration for disputes, except for claims eligible for small claims court.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the platform. Continued use after changes constitutes acceptance of the new Terms.
